General Terms and Conditions and Customer Information

§ 1 Scope

1. These General Terms and Conditions ("Terms") apply to all contracts between Hanna Brake, Honeyz Boulevard, Bernhard-Nocht-Straße 1, 20359 Hamburg ("we") and you as a customer ("you") concluded via our online shop at www.honeyzboulevard.com. They apply to the purchase of goods and gift vouchers as well as to the booking of services.
2. Our offering is aimed at consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
3. Any terms of yours that deviate from these Terms shall not apply unless we expressly agree to them.

§ 2 Conclusion of Contract

1. The presentation of our goods, gift vouchers, and services in the online shop does not constitute a binding offer, but rather an invitation for you to submit an offer yourself.
2. You place the desired items in the shopping cart. Before submitting your order, the order summary shows you all details, the total price, and the shipping costs. You can identify and correct input errors before submitting, using the usual browser functions and the controls in the order process. By clicking the order button, you submit a binding offer.
3. We confirm receipt of your order by email. This acknowledgement of receipt does not yet constitute acceptance of your offer. The contract is concluded when we accept your offer, either by an order confirmation sent by email or by shipping the goods, whichever occurs first. For gift vouchers, the contract is concluded upon dispatch of the voucher.
4. The language of the contract is German. We store the text of the contract and send you the order details and these Terms by email. You can view the Terms in our online shop at any time.

§ 3 Prices and Shipping Costs

1. All prices are total prices in euros and include statutory value-added tax.
2. Shipping costs are charged in addition. They depend on the size of the package and the destination country and are shown to you before you complete your order. Current rates can be found in our “Shipping Costs and Delivery” overview. We do not offer free shipping.
3. We deliver exclusively to Germany and Austria.

§ 4 Payment

1. You can use the following payment methods in our online shop: credit card (Visa, Mastercard), PayPal, Klarna, and Apple Pay and Google Pay. Which payment methods are available for your order is shown during the order process.
2. When paying by credit card, PayPal, Apple Pay, or Google Pay, the purchase price becomes due upon completion of your order and is charged to your account. When paying with Klarna, the payment terms that Klarna displays to you during the order process apply, including the payment deadlines stated there. Klarna may require a credit check. In that case, payment is processed via Klarna, and Klarna's terms apply in addition.

§ 5 Delivery

1. We ship your order via Hermes Germany GmbH to the delivery address you provide. Delivery times can be found in our “Shipping Costs and Delivery” overview and in the respective product description. No delivery takes place on Sundays or public holidays.
2. The risk of accidental loss or accidental deterioration of the goods passes to you once we have handed the goods over to you.
3. We are entitled to make partial deliveries, provided this is reasonable for you. No additional shipping costs will arise from this.
4. If an ordered item is unavailable, we will inform you without delay and promptly refund any payments already made for that item.

§ 6 Retention of Title

1. The delivered goods remain our property until paid for in full.

§ 7 Gift Vouchers

1. By purchasing a gift voucher, you acquire a credit balance that you can redeem for goods and services from Honeyz Boulevard. The voucher is redeemable in person at the studio.
2. Unless stated otherwise, the voucher is redeemable for the statutory limitation period of three years, beginning at the end of the year in which it was purchased.
3. If the order value exceeds the credit balance, you pay the difference using one of the payment methods offered. If the credit balance exceeds the order value, the remaining balance is retained. A cash payout is excluded to the extent permitted by law.
4. The statutory right of withdrawal applies to the purchase of a gift voucher in accordance with our Right of Withdrawal notice.

§ 8 Services and Appointments

1. When booking a service, the contract is concluded upon our confirmation of the appointment. We provide the service at the agreed appointment to the best of our knowledge, either in person or through suitable third parties.
2. Please arrive on time and cooperate with the service as needed. In the event of a late arrival, the service may be shortened without a change in price if we are unable to provide it in full due to the later start.
3. Booking, Deposit, and Missed Appointments

   1. Binding Appointment Booking and Deposit

   A binding appointment is made once the appointment is confirmed. A deposit must be paid to reserve the appointment. This deposit is credited in full toward the agreed treatment price once the appointment is carried out.

   2. Cancellation or Rescheduling Up to 48 Hours Before the Appointment

   Appointments can be cancelled or rescheduled free of charge up to 48 hours before the agreed appointment at the latest.

   If cancelled in time, any deposit already paid will be refunded. If an appointment is rescheduled, the deposit can be carried over to the newly agreed appointment.

   3. Late Cancellation or No-Show

   If the cancellation occurs less than 48 hours before the agreed appointment, or if the customer fails to appear for the appointment without cancelling in time, HONEYZ BOULEVARD reserves the right to charge a cancellation fee of up to 100% of the treatment price agreed for the reserved appointment, provided the reserved time slot cannot be filled otherwise.

   Any deposit already paid will be credited toward the cancellation fee.

   The customer expressly retains the right to prove that HONEYZ BOULEVARD suffered no loss, or a substantially lower loss, as a result of the cancellation or no-show.

   To the extent HONEYZ BOULEVARD saves expenses as a result of the missed appointment, or is able to fill the reserved time slot otherwise, this will be taken into account when calculating the cancellation fee.

   4. Cancellation by HONEYZ BOULEVARD

   If an appointment must be cancelled by HONEYZ BOULEVARD, any deposit already paid will, upon request, be refunded in full or carried over to a new appointment. Further statutory claims remain unaffected.

§ 9 Right of Withdrawal

1. As a consumer, you have a statutory right of withdrawal. Details, exceptions, and the model withdrawal form can be found in our Right of Withdrawal notice. Information on returns can be found under “Returning Products”.

§ 10 Warranty

1. The statutory warranty rights apply. For new goods, the limitation period is two years from delivery.
2. Please check the goods upon receipt for completeness and obvious defects or transport damage and report these as soon as possible. Your statutory rights are not affected by this.

§ 11 Liability

1. We are liable without limitation for intent and gross negligence, for injury to life, body, or health, for fraudulently concealed defects, for assumed guarantees, and under the Product Liability Act.
2. In the case of slightly negligent breach of a material contractual obligation — that is, an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on which you may regularly rely — our liability is limited to the foreseeable damage typical for this type of contract.
3. Beyond that, our liability for slight negligence is excluded. This also applies to our vicarious agents.

§ 12 Dispute Resolution

1. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. For questions or complaints, you can reach us at support@honeyzboulevard.com.

§ 13 Applicable Law

1. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.

§ 14 Final Provisions

1. Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by the applicable statutory provision.

5. Right of Withdrawal

You have a right of withdrawal. Instructions, exceptions, and the model withdrawal form can be found in our Right of Withdrawal notice.

6. Statutory Warranty Rights

Statutory warranty rights apply to our goods (see § 10).
